Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regulations 28-16-57 through 63, 28-18-1 through 15, 28-18a-1 through 32, 28-16-150 through 154, 28-46-7, and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The proposed actions concerning the draft documents are based on staff review, applying the appropriate standards, regulations and effluent limitations of the state of Kansas and the Environmental Protection Agency. The final action will result in a Federal National Pollutant Discharge Elimination System Authorization and/or a Kansas Water Pollution Control permit being issued, subject to certain conditions, revocation and reissuance of the designated permit or termination of the designated permit.

Facility Description: The proposed action is to modify an existing permit for the discharge of wastewater during coal mining operations by adding three outfalls. This is a surface bituminous coal mining operation. Mined coal is transported to a coal processing plant located at Garland Mine No. 1, where it is crushed, screened and washed. Stormwater runoff and active strip pit dewatering flows are directed to sediment traps and ponds for settling prior to discharge through outfalls at this facility. All discharges are precipitation based. The proposed permit for the added outfalls includes limits for total recoverable iron, total suspended solids, settleable solids and pH, as well as monitoring for total recoverable zinc, total hardness, sulfates and effluent flow.

Facility Location: Intersection of N.W. Indiana and 1350 Roads, Mont Ida, Kansas

Facility Description: The proposed action is to reissue an existingwastewater permit for an existing nonoverflowing wastewater retention system. This facility is a slaughterhouse and meat processing operation that handles up to 10 animals per week. Domestic and process wastewater is presently directed to a single-cell lagoon and upon construction of the second cell will be directed to a two-cell nonoverflowing earthen lagoon with irrigation option. Hides, offal, blood and solid waste will be removed by contract with a by-product processor. Lagoon sludge may be disposed of in a solid waste landfill or in accordance with an approved land application plan. The maximum expected wastewater flow into the lagoon is about 20,000 gallons per month. Discharge of wastewater from this treatment facility to surface waters of the state of Kansas is prohibited by this permit.

Facility Description: The proposed action is to reissue an existing pretreatment permit for this facility. This facility rebuilds jet aircraft engines and performs cleaning and chemical etching of aluminum, various alloys and steel parts. Wastewater pretreatment includes an ultra-filtration unit, and oil/water separators and grease traps. The proposed permit contains limits for chromium, cyanide, zinc, oil and grease, total toxic organics and pH, as well as monitoring of effluent flow. The permit limits are pursuant to state and federal pretreatment requirements.

Facility Description: The proposed action is to re-public notice with corrections and then issue an Underground Injection Control Area - Class V Injection Well permit for a remediation project that includes the use of injection wells number 1, 2 and 3. Injection is into the Quaternary alluvial aquifer through screens from a depth of approximately 19 to 39 feet below ground level. The permittee is authorized to inject liquid consisting of recovered groundwater contaminated by industrial solvents, treated by air stripping, to which potassium permanganate is then added to the injection fluid. The purpose of injection is to bioremediate the soil and aquifer and maintain hydraulic control of the site. The maximum wellhead injection pressure limit for this project is 50 psig. The maximum rate of flow for the project is 1,008,000 gallons per week. The construction, monitoring and operation of these wells shall meet the requirements that apply to Class V injection wells under K.A.R. 28-46-1 through 28-46- 42 and K.A.R. 28-30-1 through K.A.R. 28-30-10.

Persons wishing to comment on the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment if they wish to have the comments considered in the decision-making process. Comments should be submitted to the attention of the Livestock Waste Management Section for agricultural-related draft documents or applications, or to the Technical Services Section for all other permits, at the Kansas Department of Health and Environment, Division of Environment, Bureau of Water, 1000 S.W. Jackson St., Suite 420, Topeka, 66612-1367.

All comments regarding the draft documents or application notices received on or before July 10 will be considered in the formulation of the final determinations regarding this public notice. Please refer to the appropriate Kansas document number (KS-AG-10-065/066, KS-Q-10- 070/071, KS-NQ-10-007, KS-PT-10-012, KS-EG-010-018) and name of the applicant/permittee when preparing comments. After review of any comments received during the public notice period, the Secretary of Health and Environment will issue a determination regarding final agency action on each draft document/application. If response to any draft document/application indicates significant public interest, a public hearing may be held in conformance with K.A.R. 28-16-61 (28-46-21 for UIC).

All draft documents/applications and the supporting information including any comments received are on file and may be inspected at the offices of the Kansas Department of Health and Environment, Bureau of Water. These documents are available upon request at the copying cost assessed by KDHE. Application information and components of plans and specifications for all new and expanding swine facilities are available on the Internet at http://www.kdheks.gov/feedlots. Division of Environment offices are open from 8 a.m. to 5 p.m. Monday through Friday, excluding holidays.
