NOTICE OF RULEMAKING - FINAL RULE

AUTHORITY: In compliance with Sections 67-5224 and 67-5291, Idaho Code, notice is hereby given that the Legislature has taken action by concurrent resolution on the pending rule promulgated under Docket No. 46-0101-1101 and that the agency is publishing this notice of final rulemaking pursuant to that legislative action. This agency action is authorized pursuant to Sections 54-2105 and 67-5291, Idaho Code.

DESCRIPTIVE SUMMARY: The following is a concise explanatory statement of the reasons for publishing the final rule and a statement of any change between the text of the pending rule and text of the final rule with an explanation for any changes:

Pursuant to House Concurrent Resolution 37, Section 100, Subsection 02, Paragraph c., of the pending rule promulgated under Docket No. 46-0101-1101 is not consistent with legislative intent and has been rejected and declared null, void and of no force and effect.

In accordance with the concurrent resolution, the affected Paragraph 100.02.c. remains as currently codified without amendment and Subsection 100.02 is being republished here in its final codified version following this notice. The remainder of the docket has been codified into the Idaho Administrative Code in accordance with the provisions of House Concurrent Resolution 37.

The original text of the proposed rule was published in the October 5, 2011 Idaho Administrative Bulletin, Vol. 11-10, pages 225 through 231. The pending rule was published in the December 7, 2011 Idaho Administrative Bulletin, Vol. 11-12, page 107.

THE FOLLOWING IS THE FINAL TEXT OF DOCKET NO. 46-0101-1101 SECTIONS AFFECTED BY HCR 37, ONLY

100. CERTIFICATION OF VETERINARY TECHNICIANS.

Any person representing himself as a veterinary technician, licensed veterinary technician, registered veterinary technician, or certified veterinary technician, shall hold a valid, unexpired certificate to practice veterinary technology in the state of Idaho. (3-30-07)

02. Application for Certification -- Fee -- Deadline -- Validity. (3-30-01)

a. A completed application, other required documents, and first year's certification fee in the amount established by the Board shall be received at the Board office by the first day of January or June. (3-30-01)

b. The Board will review applications and issue certifications in January and June of each year. Veterinary Technician Certifications shall be consecutively numbered beginning with the number one (1) and all numbers shall be prefixed with the letters CVT. If an applicant is found not qualified, the Board shall notify the applicant in writing of such finding and grounds therefor. An applicant denied certification may request a hearing pursuant to the procedures set forth in Title 67, Chapter 52, Idaho Code. Any applicant who is denied certification shall be allowed the return of the certification fee portion of the application fee. (3-30-01)

c. Any applicant taking and passing the Idaho Veterinary Technician Jurisprudence Examination and not wanting to be certified at the next review by the Board shall be allowed the return of the certification fee portion of the application fee only. (3-30-01)
