NOTICE OF PROPOSED RULEMAKING

 

NOTICE IS HEREBY GIVEN that the Superintendent of Insurance (“Superintendent”),pursuant to the New Mexico Insurance Code, Sections 59A-l -1 et seq. NMSA 1978 (“InsuranceCode”) and 13.1.4 NMAC, proposes toadopt new rules: 13.10.33 NMAC - SURPRISE BILLING.

 

PURPOSE OF THEPROPOSED RULES: To implement consumerprotection, reimbursement, refund, reporting and appeal requirements for the SurpriseBilling Protection Act.

 

STATUTORY AUTHORITY: Section 59A-2-9 NMSA 1978, Sections 59A-57A-1 through 59A-57A-13NMSA 1978 and Section 59A-16-21.3 NMSA 1978.

OSIwill hold a public video/telephonic hearing on the proposed rules on December28, 2020 at 1:00 p.m.

TheSuperintendent designates R. Alfred Walker to act as the hearing officer forthis rulemaking.  Oral comments will beaccepted at the video/telephonic hearing from members of the public and anyinterested parties.

 

Written comments and proposals will be acceptedthrough 4:00 pm on December 28, 2020.  Responses to written comments or oral commentswill be accepted through 4:00 pm on January 7, 2021. Only signed statements, proposals or comments will beaccepted.  Scanned or electronicsignatures conforming to federal and state court requirements will be acceptedwith the understanding that if there is any dispute regarding a signature, OSIreserves the right to require that original signatures be provided to verifythe electronic or facsimile signature. All filings must be received between the hours of 8:00 a.m. and 4:00p.m. Monday through Friday except on state holidays.  Any filings after 4:00 will be filed to thedocket the next business day.

 

SPECIAL NEEDS:  Any person with a disability who is in needof a reader, amplifier, qualified sign language interpreter, or other auxiliaryaid or service to attend or participate in the hearing should contact MelissaGutierrez at 505-476-0333 ten (10) business days prior to the hearing.
